By accessing or using terencemgl.com (the “Site”), including making a purchase, signing up for updates, or otherwise using content on it, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Site.
This Site is owned and operated by Terence MG Leaño (“I,” “me,” “my”), operating under the names ThroatSingKing (TSK) and Eso•Terence, based in Windsor, Ontario, Canada.
All content on this Site — including videos, audio, chants, mantras, music, artwork, photographs, logos (including the TSK and Eso•Terence marks), text, and designs — is owned by me or used with permission, and is protected by copyright and other intellectual property laws. You may view and share content for personal, non-commercial use, but you may not reproduce, redistribute, resell, remix, or use any content commercially without my prior written permission.
The chants, mantras, and related content on this Site are shared for cultural, artistic, educational, and entertainment purposes. They are not medical, psychological, therapeutic, religious, or professional advice of any kind, and are not a substitute for consultation with a qualified professional. Any benefits described or implied — spiritual, emotional, or otherwise — are not guaranteed and may vary by individual. You use this content, and any related practices, entirely at your own discretion and risk.
Merchandise sold through this Site is produced and fulfilled by third-party print-on-demand partners (such as Printful). By placing an order, you acknowledge and agree that:
Nothing in this section limits any statutory rights you have as a consumer under applicable law, including Ontario’s Consumer Protection Act, 2002, which cannot be waived by contract.
If you book or commission services through this Site (for example, collaborations, sessions, or custom work), the specific scope, pricing, timeline, and deliverables will be agreed separately, by email, invoice, or contract. Unless otherwise agreed in writing, deposits are non-refundable once work has begun. I do not guarantee specific creative outcomes, though I will work in good faith to fulfill agreed deliverables.
Unless a separate commercial or sync license has been purchased in writing, any custom vocal recording commissioned through this Site is licensed for personal, non-commercial use only. Personal use means private use by you — for example, your own devotional or ceremonial practice, or a personal project that is not distributed publicly, broadcast, or monetized in any way.
Commercial use means any use of the recording in, or in connection with, a film, game, advertisement, monetized video or podcast, album or other public release, or any other project intended for distribution, broadcast, or monetization. Commercial use of any kind requires a separate commercial (sync) license, quoted and agreed to in advance of that use.
Using a custom vocal recording commercially without a separate license is a violation of the license it was provided under, and may result in a takedown request and/or legal action.
You agree not to use the Site to violate any law; infringe on the intellectual property or other rights of others; upload harmful code; attempt to gain unauthorized access to the Site or its systems; or use bots, scrapers, or other automated means to access the Site without permission.
The Site may link to or embed third-party platforms, including YouTube, Instagram, TikTok, Facebook, Printful, PayPal, and email service providers. I don’t control these third parties and am not responsible for their content, policies, or practices. Your use of them is subject to their own terms and privacy policies.
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. I don’t guarantee the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of — or inability to use — the Site, its content, or any products or services purchased through it, even if I have been advised of the possibility of such damages. Where liability cannot be fully excluded under applicable law, my total liability to you for any claim will be limited to the amount you actually paid me in the 12 months before the claim arose, or $100 CAD if you did not pay anything.
This limitation does not apply to liability that cannot be limited or excluded under applicable law — for example, liability for gross negligence, willful misconduct, or certain consumer-protection claims that cannot be waived.
You agree to indemnify and hold me harmless from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your use of the Site, your violation of these Terms, or your violation of any rights of another person or entity.
I may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after changes are posted means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
